When the damages or cost of injuries exceed the insured's primary coverage amount, it depends on whether the insured has an excess liability clause in his or her contract. If the insured has an excess liability clause, this might have the insurance company pay for some or all of the excess liability. If the insurance company has somehow received prior knowledge that the claim against the insured was worth more than the primary insurance policy, however, the company will be forced to pay this excess liability.
