How long does a federal appeal take?

Because of the backlog of pending cases, most federal appeals take over a year to process. Once a case is before an appellate court, however, review is normally quite short. Appellate judges focus on the lower court record, determining whether or not a legal error occurred during the proceedings. Courts of appeals will frequently decline to hear oral arguments, relying entirely on appellant briefs and written transcripts of the trial instead. This can take less than an hour in many cases.
