What is mandatory sentencing?

Mandatory sentencing is a form of criminal punishment where a sentencing judge has little-to-no control over the sentence imposed upon a person convicted of a crime. Mandatory sentences are established by state and federal law and vary depending on the nature of the crime committed. Such sentencing procedures are controversial – proponents argue that they enforce impartiality of the legal system and deter crime while opponents argue that they prevent courts from looking at the circumstances surrounding a crime – but common. The term is also referred to as mandatory punishment of fixed sentencing.
