If an officer has probable cause to ask a person for a breath test, meaning the officer has reasonable suspicion that the person is intoxicated and therefore has the right to investigate that suspicion, a refusal to take the breath test could cause the person to lose his license for some period of time. Some states assume implied consent on behalf of their drivers, meaning that by driving in that state a person is already agreeing to take a breath test if an officer asks the person for one rightfully. If someone refuses to do so, the person can lose her license for one year or more. Also, refusing a breath test can often be used against someone later in court, and in some places, a warrant for a blood test can be granted despite a refusal to take a test.
