Saint Petersburg, Florida Criminal Appeals Lawyer Michael Bowdish answers:
What is appellate law?
Appellate law consists of presenting an already decided case to a higher court in order to review the decisions of the lower court in which it originally took place. Typically, an appeal may be successful when there has been a legal error in the first evaluation of a case. An appeal may result in the reversal of the lower court's decision, an affirmation of the lower court's decision, or the vacating (cancellation) of the decision, which would cause the case to be re-tried. There are lawyers who specialize particularly in appellate law and have a high level of experience in appealing cases with unfavorable decisions in lower courts. Appeals may be used in both civil and criminal trials, but a case in which a person is charged with a crime and found not guilty is not subject to an appeal.
