What if the other party does not have insurance?
If the other party does not have insurance in an accident case in Colorado, you may still have avenues to seek compensation. Colorado requires that all drivers carry a minimum amount of liability insurance. If the other party is uninsured, you may be able to seek compensation from your own insurance company. This is referred to as uninsured motorist coverage, and most insurance policies in Colorado have this type of coverage for cases when the other party is uninsured. If you do not have uninsured motorist coverage on your policy, you may have to try and seek compensation from the other party directly. If the other party does not have any assets, it may be difficult to recover anything from them, as it would be difficult to garnish wages, etc. In this case, you can still try to recover damages from them through small claims court, however, it may be difficult to collect if the other party does not have financial assets. Finally, if the other party is at fault in the accident, you may also be entitled to punitive damages, in addition to any compensatory damages, which are based on the fault of the other party in the accident. However, because the other party does not have insurance, it may be difficult to pursue punitive damages in this case.
