What is a civil case?
A civil case is a legal dispute between two or more parties in which the plaintiff (the person bringing the lawsuit) seeks a remedy, such as money, from the defendant. Civil cases are usually brought to court in order to resolve disputes regarding monetary damages, contracts, property, and other rights. In California, there are certain types of civil cases that are related to accident law, including personal injury, professional malpractice, and product liability. In a personal injury case, the plaintiff (the injured person) claims that the defendant’s negligence caused their injury. The injured person must prove that the defendant was at fault and that the injury was directly caused by the defendant’s negligence. In a professional malpractice case, the plaintiff alleges that the professional’s negligence or wrongful conduct caused the harm in question. To prove this, the plaintiff must show that the professional was negligent, meaning they failed to meet the accepted standards of care in their profession. In a product liability case, the plaintiff alleges that some sort of defect or fault in a product caused the injury or harm. The plaintiff must prove that the product was defective or faulty and that this defect caused the injury. These are just a few examples of civil cases that might be brought up in California, but there are many different types of civil cases in the legal system. In all civil cases, the plaintiff must prove that the defendant was at fault or acted negligently in order to win their case.
