What is a civil case?

A civil case is when a person or business files a lawsuit against another person or business. This is different from a criminal case where the state or federal government brings charges against an individual or business. In Delaware, civil cases are heard in the Court of Chancery or the Court of Common Pleas. Civil cases can involve a variety of legal issues, including money damages for injury or breach of contract. Examples of accident law that may be heard in civil court include personal injury, wrongful death, medical malpractice, product liability, and premises liability. In a civil case, the person filing the lawsuit is known as the plaintiff and the person being sued is known as the defendant. The plaintiff must prove that the defendant caused harm to the plaintiff or breached an agreement. In order to be successful, the plaintiff must prove that the defendant was responsible for the harm or breach of contract. If the plaintiff is successful in court, the court may order the defendant to pay money damages to the plaintiff in order to compensate the plaintiff for her or his losses. The amount of money awarded to the plaintiff is determined by the court. In some cases, the court may also order the defendant to take specific steps to remedy the harm caused to the plaintiff.
