What is a third-party claim?
A third-party claim is a legal action that is taken against a third party who was involved in causing an accident that led to an injury to another person. In Colorado, these claims are typically brought against an at-fault driver, property owner, or employer. When an accident occurs in Colorado that results in injury to a person, the victim may be able to file a personal injury claim against the at-fault party. This is known as a first-party claim. But if the at-fault party doesn’t have enough insurance coverage to compensate the victim for their losses, filing a claim against a third-party such as an employer or property owner may be an option. Third-party claims can be beneficial for victims because they may have a greater ability to offer the necessary compensation to cover medical bills, lost wages, and other damages associated with the injury. Oftentimes, individuals who are responsible for accidents don’t have the resources to cover the expenses associated with an injury. Because of the complex nature of third-party claims in Colorado, talking to a personal injury lawyer can be a good way to determine if filing a claim against a third party is the right decision in a given situation. A lawyer can provide advice and guidance, and help victims understand the specific laws in place to make sure they receive the compensation they deserve.
