What is a statute of limitations?
A statute of limitations is a law that establishes a limit on the amount of time a person has to file a legal claim after an accident or injury has occurred. In Minnesota, the statute of limitations for most personal injury cases is two years from the date of the accident. This means that a person must file a claim within two years of the date of the accident or injury in order to have a legal claim. The statute of limitations can be extended in certain circumstances, such as when the injured person was a minor at the time of the accident. In these cases, the statute of limitations begins on the person’s 18th birthday rather than on the date of the accident. Additionally, the statute of limitations can also be extended if the defendant was out of the state or country during the two-year period following the accident. The purpose of the statute of limitations is to ensure that claims are filed in a timely manner and that evidence is still available. By having a statute of limitations in place, plaintiffs have an incentive to file their claims in a timely manner, and defendants have an incentive to settle claims in a timely manner. Additionally, evidence such as medical records and police reports are more likely to be available if the claim is filed in a timely manner.
