What is an alternative dispute resolution?

Alternative dispute resolution (ADR) is a way of resolving disputes outside of a court. In Hawaii, ADR can include negotiation, mediation, conciliation, and arbitration. Negotiation is a discussion between two or more parties to resolve a dispute, often with the help of an attorney or mediator. Mediation is a type of ADR in which a neutral third person, called a mediator, helps the parties come to an agreement. Conciliation is similar to mediation but involves a more active role on the part of the third party in making a decision. Finally, arbitration is a type of ADR in which both parties agree to present their arguments to an arbitrator who renders a binding decision. ADR can be used in many types of civil disputes, including personal injury cases related to accidents. ADR has many advantages over the traditional court system. It is usually cheaper, faster, and less formal than litigation, allowing the parties to resolve their dispute without having to go through the expense and hassle of a trial. Additionally, ADR is often a more private and less intimidating process than going to court. Ultimately, ADR can provide a quicker and more satisfactory resolution of a dispute than litigation.
