What is an alternative dispute resolution?

Alternative dispute resolution (ADR) is a way to settle disputes between two or more parties outside of the court system. ADR often involves mediation, negotiation, and arbitration. Mediation is a form of ADR in which a neutral third party—known as a mediator—facilitates negotiations between parties to help them reach an Agreement that both sides are satisfied with. Mediation is not legally binding, but the mediator will work to ensure that each party understands the implications of any proposed Agreement. Negotiation is a common form of ADR used in Washington State. In a negotiation, the parties are actively involved in the process and will typically try to reach an Agreement that is beneficial to both sides. Unlike Mediation, an Agreement reached through negotiation is legally binding and must be honored by each party. Arbitration is a form of ADR in which an impartial third party—known as an arbitrator—listens to both sides of a dispute and then makes a final and legally binding decision. Arbitration is generally considered less formal than a courtroom trial and may allow for quicker resolution of the dispute.
