When is a settlement considered taxable income?

In New Jersey, a settlement that is received as a result of a personal injury claim is generally not taxable. This includes payments received for medical expenses, lost wages, pain and suffering, and permanent impairment. However, if the settlement is for punitive damages, such as those that are awarded for intentional acts, it is taxable income in New Jersey. There are also some cases where the settlement is actually considered to be income, such as when a settlement is used to replace lost wages or to cover expenses that would otherwise be considered taxable. In addition, if a portion of the settlement is used for purposes other than the personal injury claim, the portion used is taxable. For example, if a portion of the settlement is used to purchase a new car, the amount used for the car would be considered taxable income because it is not related to the injury claim. Finally, if you receive a settlement from an insurance company, they may choose to withhold taxes from the payment. This is often done for convenience, and any taxes withheld should be reported on your annual tax return. In summary, settlements from personal injury claims are generally not taxable in New Jersey. However, there are some exceptions such as when the settlement is for punitive damages, or if the settlement is used for something other than the injury claim. Any taxes that are withheld from the settlement should also be reported on your tax return.
