When is a settlement considered taxable income?
In Oklahoma, a settlement for a personal injury case is not taxable income. This is because state and federal governments view any money received as compensation for a personal injury as being the “victim’s” money, as the person has already suffered an injury or loss. The government does not view settlements or awards as income, and as such, it is not taxable. However, when a court awards punitive damages in an Oklahoma personal injury case, then those punitive damages may be considered taxable income. Punitive damages are reportedly designed to punish wrongdoers and discourage them from repeating the act. Punitive damages are awarded in addition to the court-mandated compensatory damages, and those damages are taxable in Oklahoma. Additionally, if the settlement is provided for lost wages, then the recipient will have to pay taxes on the amount. The government views this type of settlement as income, and as such, it is taxable. However, if the settlement is for medical expenses that the plaintiff has already paid, then those payments are not taxable. Overall, it is important to remember that, in Oklahoma, a settlement for a personal injury case is not taxable income. However, if punitive damages, lost wages, or income-producing investments are part of the settlement, then those components may be taxable income in Oklahoma.
