What is a liability waiver?
A liability waiver is a legal document designed to protect an individual or business from legal responsibility if a person suffers an injury or property damage. A liability waiver is often used in Washington in the context of an accident, such as a car accident, or other types of accidents. By signing a liability waiver, one party agrees to waive all legal rights to seek compensation for any risks that may result from the accident. For example, imagine a person renting a boat in Washington. Before they are allowed to use the boat, they may be asked to sign a liability waiver. This would mean that if they were injured while using the boat, they would not be able to hold the boat rental company responsible for any medical expenses. In Washington, liability waivers are legally binding and must be properly formatted to stand up in court. If a waiver is not in the proper format or contains unenforceable terms, it may not be valid. For this reason, it is important to understand the terms of any liability waiver before signing it. It is important to remember that just because a person has signed a liability waiver, this does not make them immune from all liability for any accidents that may occur. It only covers accidents in the context of the activities that the waiver was signed for. Accidents caused by negligence or intentional acts are still generally not covered by liability waivers.
