What is the difference between a lawsuit and an insurance claim?

An insurance claim is a process in which an individual or entity seeks compensation for losses from an insurance company. The process begins when the policyholder reports the eligible loss to the insurance company. The insurance company then assesses the validity of the claim and decides whether or not to pay the claim. The policyholder may also negotiate the size of the payment from the insurance company. Generally, payments from an insurance company are significantly smaller than those awarded by a court in a lawsuit. In Oklahoma, the differences between a lawsuit and an insurance claim can be significant. Lawsuits must be filed in accordance with state statutes, while insurance claims are typically handled by private companies and governed by the specific terms of an individual policy.
