What do I need to prove to win a personal injury case?

In order to win a personal injury case in Arizona, the plaintiff (the individual who is bringing the case) must prove that the defendant was negligent. Negligence is defined as an individual’s failure to act in the manner that would be expected by a reasonable and prudent person. In order to prove negligence, the plaintiff must demonstrate that the defendant had a duty of care to the plaintiff (such as a duty to avoid causing harm to another), that the defendant breached this duty of care, and that the breach caused the plaintiff’s injury. The plaintiff must also prove that the injury caused them to suffer some kind of harm, such as economic losses or pain and suffering. The plaintiff must provide evidence of these components in order to make their case. This could include medical records, photos of the scene, witness statements, expert testimonies, and any other relevant evidence. If the plaintiff is able to prove all of these elements successfully, they may be able to receive financial compensation from the defendant for their injury.
