What is a toxic tort?
A toxic tort is a type of accident law in which one party (the claimant) alleges that their injury or illness was caused by dangerous or toxic chemicals or substances. These torts are usually brought against companies who manufacture, market, or use hazardous chemicals or materials. In Arizona, toxic torts are typically found in cases involving exposure to medical devices, environmental contamination, or exposure to industrial chemicals. In a toxic tort case, the injured party must prove that their injury or illness was caused by a hazardous material or chemical. They must also demonstrate that the responsible party (the defendant) was negligent or careless in their use, storage, or disposal of the toxic material. It is up to the claimant to prove that the defendant failed to exercise reasonable care in handling the materials or substances. Some common examples of toxic torts in Arizona include cases involving asbestos exposure, DEF fuel exposure, or benzene exposure. In these cases, the claimant must prove that their illness or injury was caused by exposure to toxic substances and that the defendant was responsible for the use, storage, or disposal of the hazardous material. Toxic tort cases are often complex and require experienced legal counsel. If you have been injured or have become ill due to exposure to a hazardous chemical or substance, you may have a valid claim for damages. It is important to contact a knowledgeable attorney who can evaluate your case and help you recover the compensation you deserve.
