This is done by filing a personal injury complaint in the appropriate court. Next, both parties must prepare for trial and conduct discovery. During this stage, gathering evidence, interviewing witnesses,and taking depositions are necessary. This helps both sides to determine the strength of their case. The following step is the pre-trial hearing, which is a time for both parties to discuss scheduling issues and exchange any new evidence. The court may also make decisions on certain motions that either party has brought up. Then comes the trial itself. The plaintiff and defendant present arguments, testimony, and witnesses. This is followed by closing arguments and the jury’s deliberation on the verdict. When the jury comes to a verdict, either party may choose to appeal the decision. Once all these steps have been completed, the jury renders a verdict, and damages may be awarded to the plaintiff based on the losses they have suffered. This is the end goal of every personal injury case. In some cases, the parties may choose to settle out of court.
