What is gross negligence?
Gross negligence is a term used in accident law to describe a situation in which someone has acted with reckless disregard for the safety of others. It is considered to be more serious than ordinary negligence, which is the failure to act with the same level of care that a reasonable person would in the same situation. In Oklahoma, a court will consider a person’s actions when determining if their behavior was gross negligence or ordinary negligence. Gross negligence is more than just carelessness; it’s a conscious decision to engage in unsafe behavior or disregard for somebody else’s safety. For example, if someone drives through a busy intersection while texting on their phone or drives a car while drinking alcohol, they could be found to be grossly negligent. When someone’s actions are deemed to be gross negligence, they can be held financially responsible for any injury or damages that result from their actions. The courts may require someone to pay for medical bills, physical rehabilitation, property damage, and even pain and suffering. Gross negligence is a serious legal matter in Oklahoma, and the courts may take serious measures to ensure that people are held accountable for their actions. If you have been injured due to another person’s gross negligence, it is important to speak to an experienced accident lawyer who can help you understand your rights and pursue a fair outcome.
