What is gross negligence?

Gross negligence is a legal term used to describe extreme negligence or carelessness that goes beyond mere carelessness or recklessness. It is a specific form of negligence that is considered to be extreme or reckless enough to warrant legal responsibility. In Pennsylvania, gross negligence is defined as an act or omission “so reckless as to demonstrate a substantial lack of concern for whether an injury results.” Gross negligence can involve any number of behaviors that are considered to be especially careless or dangerous, such as running a red light or failing to properly maintain a vehicle. Trying to prove gross negligence can be challenging for those who wish to pursue legal action. It is often difficult to determine whether a person’s behavior amounts to extreme negligence or simply ordinary carelessness. In general, courts will look at several factors to determine whether or not gross negligence took place in an accident, such as the degree of the carelessness, the extent of the damage, whether the person acted intentionally, and any other relevant factors. If you believe that someone’s behavior was so reckless and negligent that it caused you harm or injury, it is important to gather evidence and consult with an experienced accident lawyer. There are strict time limits on when you can file a claim, so it’s important to act quickly in order to maximize your chances of recovering damages. An experienced lawyer can review your case and help you decide the best course of action.
