What is a wrongful termination claim?

A wrongful termination claim is a legal dispute in which a person asserts they were wrongfully terminated from their job in violation of the law. This type of claim is based on the idea that employers must act in a reasonable and responsible way in their decisions to fire employees. In New Jersey, wrongful termination claims can arise due to violations of public policy, contract violations, discrimination, and retaliation. Public policy claims are based on an employee being terminated for exercising their legal rights or refusing to do something that goes against public policy. Contract violations occur when an employer fails to abide by the terms of the employment contract or fails to follow their own written employment policies. Discrimination claims occur when an employee is fired due to their protected characteristic, such as their race or gender. Finally, retaliation claims occur when an employee is fired for exercising their rights, like reporting an employer for illegal activities. In general, an employee may be able to file a wrongful termination claim if they believe their employer failed to act in a reasonable and responsible manner when making the decision to terminate them. This type of claim must then be thoroughly evaluated by a court of law. If successful, an employee may receive compensation, including back pay, punitive damages, and other forms of compensation.
