What are the jurisdictional differences between Admiralty Law and other areas of law?

Admiralty law, also known as maritime law, is a unique area of the law which helps govern behavior around bodies of water. Although it is not a state law, it applies to individuals, businesses, and the government in the state of Montana and across all other U.S. states. Admiralty law differs from other areas of law because of its specificity and the special scope of its jurisdiction. It is mostly concerned with issues that arise from activities or vessels that take place on or near bodies of water. This includes navigation and transportation law, conflicts between vessels, as well as the rights and liabilities of the vessels and their personnel. Admiralty law also governs the rights and remedies of those who sustain an injury in the course of maritime trades, and the law of insurance and other contracts between parties involved in maritime transactions. Unlike other areas of law, Admiralty law is based on a combination of statutes, regulations, and judicial rulings. In contrast, other areas of law, such as contract or criminal law, are primarily set forth in Federal and state statutes. These laws are not limited to bodies of water, and can involve any disputes or activities not related to the ocean or water vessels. It is important to understand the jurisdictional differences between Admiralty law and other areas of the law in order to determine the appropriate source of law for a particular dispute. Even if a dispute does involve a body of water, it may not fall under Admiralty law jurisdiction. In these cases, it is the responsibility of the judicial system to determine the source of law.
