What remedies are available under Admiralty Law?
Under Admiralty Law, remedies are available to settle disputes between parties regarding items such as maritime contracts, salvage, collisions, or personal injuries occurring on navigable waters. In Oklahoma, such remedies include injunctions, attachment, condemnation, and replevin. Injunctions are court orders requiring the defendant to do or avoid a specific act, such as staying a vessel in a certain port or stopping a salvage operation. Attachment is a legal process used to secure a judgment debt and seize a defendant’s assets. Condemnation involves taking private property for public use, such as a landowner losing their land to build a pier. Replevin is a court order allowing the claimer of a movable property to regain possession without having to pursue legal action for damages. Admiralty Law is also available to initiate an action in admiralty against third parties who may have contributed to the damage or injury by providing advice, materials, supplies, or services to the parties. Such parties may be responsible for indemnifying or compensating the plaintiff. Additionally, Admiralty Law provides for a remedy of damages to the aggrieved party, including lost wages, medical expenses, pain and suffering, cost of repairs or replacement of vessels or personal property, and attorney’s fees. Finally, Admiralty Law also provides for punitive damages when the court finds that the defendant acted with malicious intent, gross negligence, or reckless disregard for the safety of others.
