What are the differences between Admiralty Law and common law?
Admiralty law, sometimes also referred to as maritime law, is a body of law which governs a wide range of maritime related activities, such as contracts involving shipping, navigation, and marine insurance. Admiralty law applies to any activity taking place on the water, whether it is on a boat, ship, or another type of vessel. In Oklahoma, admiralty law is regulated by the United States Code, Title 46, which sets out specific rules and regulations regarding the use of vessels on navigable waters. Common law is a body of law that is established by the courts through their decisions and has been repeated and formally recognized by the courts. Common law is not codified and is based on precedent, meaning the outcomes of court cases that have come before it. Common law applies to a variety of legal issues, including property, contracts, torts, and criminal matters. The main difference between admiralty law and common law is the scope of their application. While admiralty law deals exclusively with maritime activities, common law covers a much broader range of legal issues. Moreover, common law is codified in statutes, while admiralty law is not. Nonetheless, admiralty law requires courts to look to common law for guidance in determining the outcome of a case, along with other sources such as treaties and international law.
