What is the Admiralty Law of salvage?

Admiralty Law’s salvage law concerns the rights of a vessel owner and the salvage crew. Salvage can be defined as an act or process of saving cargo or a vessel in danger of perishing. In the case of maritime salvage operations, the salvage crew assists the vessel owner in saving the ship, cargo, or both. The Salvage Law of Admiralty Law provides incentives for those who voluntarily come to the aid of a vessel in danger. This includes the right to receive compensation for the labor and risk taken to save the vessel or cargo, as well as compensation for any equipment or supplies used to complete the salvage. In the State of North Carolina, the salvage award must be proportional to the value of the vessel or cargo that was salvaged, the efforts taken by the salvor, the risk of loss incurred by them, and the degree of success that was achieved. This means that the salvage award could be more or less depending on the value of the vessel/cargo, the difficulty of the salvage operation, and the amount of risk assumed by the salvor. In general, salvage operators are not liable for any damages that occur as a result of their efforts. This applies even if the damages were caused by a mistake made by the salvor. However, this may not be the case if the salvor was negligent or acted maliciously. Therefore, it is important for salvage operators to understand the applicable laws when performing a salvage operation.
