How is maritime jurisdiction determined under Admiralty Law?
Under Admiralty Law, maritime jurisdiction is determined based on the location and nature of the incident causing the harm or loss. This applies to both matters of state and federal law. In Georgia, federal admiralty law applies to all interstate maritime commerce, which covers almost all activity on navigable waters outside of state boundaries. This law is enforced by the U.S. Coast Guard and the U.S. Maritime Administration. The coast guard is in charge of enforcing federal, state, and local laws while the Maritime Administration provides both navigation and safety services. Under this law, the admiralty court is the appropriate forum to handle admiralty matters. This court has authority to address matters such as collisions, salvage operations, personal injury claims, and wrongful death. The court has exclusive jurisdiction over these matters as long as the incident occurs on navigable waters. If the incident occurs within the boundaries of the state, then Georgia courts may also have jurisdiction. The admiralty court also decides which law applies to each particular case. This is especially relevant when the incident has elements of both state and federal law. The court may use state law for elements of the case that are not related to maritime matters. In this situation, the court must determine if the issue is adequately addressed by state law or if the admiralty court must apply its own laws. In short, the admiralty court has exclusive jurisdiction over maritime matters, regardless of whether the incident occurred within state boundaries or not. The court then determines which law is to be applied in the case, allowing it to decide cases that involve both state and federal law.
