What is the Admiralty Law related to marine pollution?
Admiralty Law is a branch of international law that applies to matters involving maritime activities such as navigation, trade, and transport of goods and people. In Massachusetts, it is applicable to cases related to marine pollution. In Massachusetts, the Commonwealth has created the Massachusetts Oil and Hazardous Material Release Prevention and Response Act that regulates the prevention and response to oil and hazardous material spills. This Act establishes the legal requirements for marine industries to prevent and respond to oil and hazardous material spills. It is the responsibility of the parties involved to adhere to the regulations set forth in this Act. The Act also establishes the legal requirements for the clean-up of marine pollution, which include the “Emergency Action Plans” and the “Incident Command System”. The Emergency Action Plan provides guidelines and procedures to respond to a spill. The Incident Command System is a standardized approach used to organize people and resources during a response to a spill. Both of these plans are necessary for successful prevention and response to marine pollution. The Act also provides for civil and criminal penalties for violation of the regulations. Under the Act, parties responsible for a spill can be held responsible for the cost of the clean-up and/or damages brought about by the pollution. Massachusetts is also a member of the North American Marine Protection Agreement, which is an agreement between Canada, the United States, and Mexico to protect and conserve coastal environments. Admiralty Law of Massachusetts is an important component of protecting our marine environment from marine pollution. It is important to adhere to the regulations of the Act and ensure that all parties involved are adequately prepared to respond to any spills.
