What is the scope of Admiralty Law with regard to domestic maritime law?
Admiralty Law, sometimes referred to as Maritime Law, regulates domestic maritime commerce and activities related to it. In Texas, Admiralty Law applies to a wide range of activities, from the sale and transfer of vessels to the fishing and shrimping industries, the transport of goods along the Gulf Coast, and disputes over cargo or other claims. It also has implications for the protection of the environment in the waters off the Texas coast. Admiralty Law establishes the rules and regulations that govern the relationships between those involved in maritime activities, and establishes the procedures for resolving disputes arising out of these activities. It also sets forth the rights and obligations of the parties when a dispute arises and what rights they may assert. It also establishes what is known as the “common law of the sea” which includes things like the rights of vessels, navigation rules, and the legal duties of vessel owners and operators. Texas Admiralty Law also applies to areas such as shipping and navigation, cargo claims, marine loans, vessel and charter party disputes, personal injury and accident claims, and death claims. It also applies to the commercial activities of tug boat operators, ship owners and builders, and the fishing and shipping industries. As such, it provides an expansive scope of protection to those engaged in maritime activities in Texas, from commercial operators to the individuals participating in them.
