What is the scope of Admiralty Law with respect to maritime environmental regulation?

Admiralty law, also known as maritime law, has a broad scope of application and includes the regulation of maritime environmental issues. In North Carolina, state and federal agencies have the authority to enforce environmental regulations on navigable waters with the help of the laws of the State of North Carolina, the United States, and various international treaties. The most common types of maritime environmental regulations in North Carolina are water-quality standards, the disposal of wastes, and the prevention of the introduction of nonnative species into the state’s waters. Water-quality standards establish levels of pollutants in the water and impose limits on the concentration of pollutants in the water. All discharges into navigable waters are regulated by the Clean Water Act and effluent limitations and standards are established for wastewater treatment plants and other industrial facilities. In addition, the Marine Protection, Research, and Sanctuaries Act and the Oil Pollution Act, both of which are federal statutes, regulate oil spills. Admiralty law also applies to environmental regulation related to the introduction of nonnative species into the state’s waters. To prevent the introduction of such species, the state of North Carolina, the United States, and individual vessels must adhere to the requirements of the Nonindigenous Aquatic Nuisance Prevention and Control Act. This Act requires vessels to have a permit to operate in designated waters and imposes inspection and decontamination requirements. Admiralty law is an expansive field of law with far-reaching implications for maritime environmental regulation in North Carolina. It is important for individuals and businesses to understand the regulations in place, as failure to comply can lead to serious consequences.
