What is administrative law?

Administrative law is the body of law that governs the activities of administrative agencies of government. In Georgia, administrative law covers the rules, regulations, and procedures of state government agencies. These agencies include but are not limited to the Department of Natural Resources, the Environmental Protection Division, and the Agency for Health Care Administration. Administrative law is found in federal and state legislation, as well as in court decisions and agency rules and regulations. The purpose of administrative law is to provide for the efficient and fair administration of state government agencies. For example, if a person has a dispute with a state agency, like the Department of Natural Resources, administrative law provides a process to resolve the dispute. Administrative law can also provide a convenient way to regulate agencies and to ensure that they are held accountable for their decisions. For example, administrative law can set forth requirements for agencies to follow in the development of rules and regulations, or can provide for public comment periods in which members of the public can provide their thoughts and opinions to the agency. Ultimately, administrative law in Georgia provides a legal framework for government agencies to operate within. It helps to ensure they make decisions that are both fair and reasonable.
