What is administrative law?

Administrative law is a branch of law that determines the rules and regulations which govern the actions of federal, state, and local government agencies. It is responsible for the procedures of these government agencies and defines how they interact with the public, businesses, and other entities. In South Carolina, administrative law is defined by the South Carolina Administrative Procedures Act. This act states that any rule a governmental agency intends to enforce must be in accord with the federal law, the South Carolina constitution, and the laws of the State of South Carolina. Administrative law also governs the agencies’ interactions with the public. It outlines procedures for holding public hearings, publishing of notices, and outlining administrative processes. Additionally, it requires agencies to adhere to the principles of fairness and justice when dealing with an individual’s rights or a business’s property rights. Administrative law also includes oversight by the courts. If a governmental agency fails to comply with the requirements of administrative law, a person or entity affected by the agency’s actions may take legal action in order to challenge it. The courts have the power to review such actions and issue a ruling if the agency has exceeded its authority. Administrative law helps ensure that all government activities are conducted fairly, efficiently, and in accordance with public policy. It is an important aspect of government accountability and helps protect citizens from oppressive government practices.
