What are the differences between administrative law and civil law?
Administrative Law and civil law both have a role in governing individuals and organizations in North Carolina. Both sets of law determine the rules and regulations of activities and organizations, but there are many differences between the two. Civil law is based on a system of court precedents that operate within the framework of the United States Constitution. It creates and interprets rules of conduct within a specific state or country. Civil law works to protect citizens’ fundamental rights to property rights, freedom of religion, and other basic rights. Civil law also determines how those rights are enforced through the courts. Administrative law, on the other hand, is a law that governs the activities of government agencies in North Carolina. Administrative law is created and enforced by administrative agencies, such as the Department of Motor Vehicles, the Environmental Protection Agency, and the North Carolina Department of Revenue. Administrative law is typically enacted in the form of regulations, which are designed to protect citizens from hazardous activities or to encourage particular social policies. Though both civil law and administrative law have roles in governing activities and organizations in North Carolina, there are important differences between the two. Civil law is based upon precedent and is designed to protect citizens’ fundamental rights, while administrative law is created and enforced by administrative agencies to protect citizens from hazardous activities or to encourage particular social policies.
