What is adoption law?

Adoption law in Texas refers to the legal process by which an adult becomes the legal parent of another individual, often referred to as the adopted child. Adoption law in Texas sets out the requirements for individuals and agencies to properly process an adoption. There are several types of adoptions, including stepparent adoptions, agency adoptions, and adult adoptions. The Texas Department of Family and Protective Services (DFPS) oversees all adoptions in the state. To begin the adoption process, an adult must file a petition for adoption in court. The petition must include the names and addresses of all parties to the adoption. The court will review the petition and determine if the adoption is in the best interests of the child. If so, the court will issue an Adoption Order, which makes the adopted child the legal child of the adopting parent. After the Adoption Order is issued, the adopting parent may petition for a court to grant a name change for the child. This name change must be requested prior to the child reaching one year of age. Once the name change is granted, the adopting parent may apply for a birth certificate for the child with the new name. In addition to the court proceedings, a criminal background check of the adopting parent and the child’s birth parents must be completed. The DFPS must approve the adoption with a home study and will provide adoption counseling to all involved. The adoption process in Texas can be complex, but if done properly, it can bring great joy to families and children. Adoption laws in Texas aim to ensure that the adopted child is in safe and loving environment, and that the adopting parent is a fit and responsible caregiver.
