What is open adoption?

Open adoption is a form of adoption where the birth parents and adoptive family have a relationship and stay in contact with each other. Open adoption is different from closed adoption, where the birth parents remain anonymous. In open adoption, the birth parents have access to identifying information about the adoptive parents and the adoptive family has access to non-identifying information about the birth parents, including basic medical and family background. The extent of contact between the birth parents and the adoptive parents is decided by both parties. This can range from occasional letters and emails to exchanging photos and having regular visits. In New Jersey, the laws governing open adoption depend on the type of adoption. In a private adoption, both the adoptive parents and the birth parents must sign a consent form that contains information about the arrangement, including the types of contact that will be allowed. In a public adoption, conducted by the New Jersey Division of Child Protection and Permanency, the adoption is open unless both parties agree to close it. This agreement must be submitted to the court and approved in order for the adoption to be closed. Open adoption can provide benefits to both the birth and adoptive parents, including allowing the birth parents to know that the child is safe and well-cared for and allowing the adoptive parents to have an understanding of the child’s genetic and cultural background. Open adoption is increasingly popular, as it can provide a sense of security and continuity for the child and the birth parents.
