Can stepparents adopt a child?
In North Dakota, stepparents may be able to adopt a child in certain situations. According to state laws, any individual over the age of 18 may adopt a child with certain exceptions, including specified nonresidents and any other person legally prohibited from adopting. A stepparent may be able to adopt their spouse’s child if the stepparent is a resident of the state and is either legally married to the parent or the parent’s rights regarding the child have been terminated. In order for the stepparent to proceed with the adoption, the child’s other parent must voluntarily surrender their parental rights, or the court will have to terminate the other parent’s rights. If the other parent’s rights have been terminated, the stepparent may then proceed with the adoption of the child. The court may also consider a waiver of the three-month residency requirement if the stepparent is not a resident of North Dakota but is married to a resident and desires to adopt. In order for a stepparent to adopt a child, the adoption must also be in the best interest of the child and the court must approve the adoption. The court will consider such factors as the length of time the stepparent has been in the child’s life, the child’s adjustment to the stepparent, the child’s relationship to the stepparent, and whether the adoption is in the best interest of the child. If all of the necessary requirements are met and the court approves the adoption, the stepparent will be granted the same parental rights as the natural parent. This includes the right to make decisions regarding the child’s upbringing and care.
