What is a step-parent adoption?

A step-parent adoption is an adoption of a step-child in Maine. This adoption gives legal parental rights to a step-parent, such as the right to make medical decisions, the right to make educational decisions, and the right to be legally responsible for the child. In Maine, a step-parent adoption is possible when the other birth parent gives permission to the adoption or their parental rights have been terminated. Before a step-parent adoption can occur in Maine, the court must receive certain documents. This includes proof that parental rights have been terminated, proof that the step-parent and the child have had a meaningful relationship for at least one year, and a written statement that the step-parent is qualified to adopt the child. The court will also conduct a background check on the step-parent to determine if the adoption is in the child’s best interests. Once the adoption is approved, the step-parent will gain all the rights and responsibilities of a parent. This includes financial responsibilities, such as providing for the child’s needs, as well as the right to make decisions regarding the child’s care and well-being. The step-parent will also gain the right to receive the child’s Social Security benefits if the child is ever disabled or receives Social Security Benefits. In order to start the step-parent adoption process in Maine, the step-parent and the other birth parent must both appear before the court and sign the adoption paperwork. This paperwork must then be submitted to the court for final approval. Once the step-parent adoption is completed, it is irreversible and the step-parent is legally recognized as the child’s parent.
