What is a step-parent adoption?
Step-parent adoption is a process whereby a stepparent can legally adopt a stepchild in Oklahoma. This process is important for creating a legal relationship between the stepparent and stepchild, and is common in situations when one parent has passed away or when the family wishes to formalize the relationship. In order to go through with a step-parent adoption, the non-custodial biological parent must be identified and must consent to the adoption. If this is not possible, then a court may terminate the parent’s rights, allowing the adoption to move forward. The step-parent adoption process in Oklahoma typically involves filing a petition in court, and the stepparent must be cleared of any criminal activity and be in good standing with the law. The court may also require a home study and/or counseling session. After these steps have been completed, the court will review the petition and may grant the adoption, though certain limitations may apply if the child is over the age of 12. Once the court grants the adoption, the step-parent will legally become the parent of the stepchild, complete with a new birth certificate.
