What is a step-parent adoption?

Step-parent adoption is a process in which a spouse of a parent legally adopts that parent’s biological children. Step-parent adoption is relatively common and can be a great way for a step-parent to develop a stronger bond with their spouse’s children and provide them with a stable, loving family. In Texas, step-parent adoption must be done through a court process. The step-parent must file a petition asking the court to grant the adoption and, in most cases, must obtain the consent of both custodial parents and the child being adopted. The court will also typically require a home transition study to be conducted to ensure that the home environment is safe and suitable for the child. Once the court is satisfied that the adoption would be in the best interests of the child, they will grant the adoption and issue a decree of adoption to the step-parent. This decree will legally grant the step-parent all the rights and responsibilities of a natural parent, including having the right to make decisions about the child’s medical and educational needs.
