What is required for a birth parent relinquishment?

In the state of New York, the process of a birth parent relinquishing their child for adoption is understandably complex. The process begins with a birth parent appearing before a court of law and petitioning the court for the legal termination of their parental rights. The court will then assess the individual’s request for the relinquishment of parental rights and the adoption of their child. In order for a birth parent to successfully relinquish parental rights to the child, they must consent to the adoption, sign a voluntary surrender document, or appear before a court of law. The court will then hear evidence as to why the birth parent believes that adoption is in the child’s best interest and why they are choosing to surrender their parental rights. The court must also ensure that the parents are providing informed consent with full knowledge of the impacts of their decision and that they are not acting under duress. This may include a review of the surrender document to make sure that the parent is fully aware of the implications of their decision. Once all of the criteria is met, the court will then issue an order terminating the birth parent’s rights to the child and the adoption process can begin.
