What is an independent adoption?

Independent adoption is a type of adoption in Florida where the birth parent(s) voluntarily relinquish all parental rights to their child to the adoptive parent(s). Unlike other types of adoption, where social services or the court system are involved in the process, an independent adoption in Florida is handled directly between the two parties. The birth parent(s) and adoptive parent(s) will enter into an adoption agreement that specifies the terms of the adoption such as the legal rights and obligations of the birth parent(s) and adoptive parent(s) as well as any other requirements of the adoptive parent(s). This agreement will be finalized and signed by both parties and filed with the court. Both parties will also be required to submit to a criminal background check and may need to attend a counseling session. Once the adoption agreement is approved by the court, the birth parent will no longer have any legal rights or responsibilities to the child. The adoptive parent(s) will become the legal parents of the child and will be responsible for all decisions regarding the child’s upbringing. The adoptive parent(s) will have all of the parental rights and responsibilities as any other parent who did not adopt their child. Independent adoption in Florida provides an efficient and cost-effective way for couples to create a legally binding relationship between them and their adoptive child. It is an important alternative for birth parents and adoptive parents who do not wish to use traditional adoption services.
