What is an independent adoption?

An independent adoption is a type of adoption that occurs without the involvement of an adoption agency. In Texas, the independent adoption process usually begins when a birth mother chooses prospective adoptive parents. However, the process must be overseen by a qualified, authorized attorney. The birth mother undergoes medical and psychological evaluations to ensure she is making an informed decision. Medical records and home studies are also required. Once this process is complete, the birth mother signs a consent form allowing the adoption to take place. The prospective adoptive parents must also undergo an evaluation and home study. In some cases, the court may require the parents to participate in psychological counseling or parenting classes. Once all the requirements are met, the court will enter a legal decree of adoption. An independent adoption is considered legally binding and all the rights and responsibilities of a natural parent are granted to the adoptive parents. Independent adoption has become more popular in recent years as it allows birth parents and adoptive parents more control over the process. It often costs less than adoptions that use an agency and allows for greater privacy.
