What are the rules for international adoption?

International adoption refers to the process of adopting a child from a foreign country. In Indiana, the rules for international adoption are in place to ensure the safety of the child and that all of the requirements of the adoptive parents and foreign country have been met. According to Indiana Code 31-19-3, all international adoptions must be handled through a licensed child-placing agency, such as a domestic or foreign agency, or an individual or family approved by the Indiana Department of Child Services (DCS). These agencies must follow the laws of both the United States and the foreign country. When filing a petition to adopt a child from a foreign country, the petition must include a statement from the foreign country approving the adoption. Additionally, the adoptive parents must provide evidence that they are able to provide a safe and secure home environment, have gone through a criminal background check, and have the financial resources to support the child. The adoptive parents must also be over the age of 18 and meet the age requirements set forth by the foreign country. Once the petition is approved, the petitioners must then complete certain pre-adoption requirements, such as an evaluation of the child’s home country and a physical and psychological examination of the child. Adoption hearings must be held in the child’s home country to complete the adoption process. After the foreign court system approves the adoption, the parents must apply for the child’s U.S. citizenship through the U.S. Citizenship and Immigration Services.
