What is a post-adoption contact agreement?

A post-adoption contact agreement is an agreement between the adoptive parents and the biological parents of a child regarding communication and contact after the adoption is complete. In Delaware, contact between an adoptee and their biological family is regulated by Delaware’s Adoption Code. Post-adoption contact agreements are voluntary agreements that can be entered into by the adoptive parents and the biological parents. These agreements allow the biological parents to maintain contact with the adoptee and the adoptive parents throughout the adoptee’s life. This contact can be in various forms, such as letters, emails, phone calls, meetings, or even visits. The adoptee’s best interests are always paramount and all contact arrangements must be made with the adoptee’s safety, health, and well-being in mind. The post-adoption contact agreement should be customized to the needs of the adoptive family and the biological family, and should be clear and detailed. Depending on the situation, it may cover topics such as the frequency and mode of contact, who will initiate contact, when contact will be made, and who will be responsible for transportation. The post-adoption contact agreement is a way for adoptive families and biological families to stay connected and have ongoing communication with one another while also protecting the needs of the adoptee. Such agreements are encouraged by the Delaware Adoption Code and must be in compliance with the Code’s provisions.
