What are the laws regarding adoption records?

In Florida, the laws regarding adoption records are outlined in the Florida Adoption Act. This act provides that certain records related to an adopted child, such as original birth certificates, adoption petitions and decrees, are confidential and not open to the public. However, the law does provide for certain exceptions. The adopted person, their legal guardian or in some cases their adoptive parents, may be granted access to these records upon request. Additionally, an agency or other organization involved in the adoption process may be allowed access to the records if they are necessary to provide appropriate services to the adopted person. The Florida Adoption Act also requires adoption service providers to maintain records of all adoptions they facilitate. These records must include detailed information about the adoptive parents and their relationship with the adopted person. This information is used to ensure the rights and safety of the adopted person, as well as to monitor the progress of the adoption process. The law also provides for sealed adoption records. Sealing records means that they cannot be accessed by anyone, even the adopted person, unless the court grants permission. This is done to protect an adopted person’s privacy and to preserve their family relationship. The court may decide to unseal records if it is in the best interests of the adopted person or of the public.
