What is mediation?

Mediation is a form of Alternative Dispute Resolution (ADR) law in Alaska that is designed to help people reach a resolution outside of a courtroom setting. Mediation is a process that can be utilized when two or more parties are involved in a dispute and want to reach a resolution together. It is a voluntary process where an impartial third-party Mediator assists the parties in exploring all options and helps them work towards an agreement. The Mediator does not act as a judge or decision-maker, but instead facilitates a dialogue between the parties to help them come to a resolution on their own. During mediation, the Mediator will help the parties sort out the facts of the dispute, discuss their interests and concerns, explore potential solutions, and work to come to a mutually acceptable agreement. Mediation is a less expensive, quicker, and more informal process compared to going to court. In Alaska, state laws regulate the process of mediation and who can be certified as a Mediator. Mediation can be an effective and beneficial method to help parties resolve a dispute.
