What is mediation?

Mediation is a type of alternative dispute resolution (ADR) law. It is a process in which two or more parties (such as two businesses or an individual and a business) are able to work together to come to a mutually acceptable agreement without having to go to court. In the state of Arkansas, mediation is facilitated by an impartial third-party, known as a mediator, who is trained in the area of dispute resolution. The mediator’s role is to listen to both sides of the story, discuss the issues and provide information about possible solutions. Parties involved in mediation do not have to agree on a solution—they can reach a compromise or agree to disagree. Mediation is often a more cost-effective and efficient way to resolve disputes than litigation. It also allows the parties to maintain control over the outcome, prevents court delays and can help preserve relationships between people.
