How do arbitration awards differ from court judgments?

Arbitration awards and court judgments differ in a few important ways. First, arbitration awards are determined by arbitrators, rather than judges or juries. The arbitrator is usually a lawyer or other qualified professional who has been trained in alternative dispute resolution (ADR) and has knowledge of the legal issues and facts involved in the dispute. The arbitrator listens to the evidence and arguments presented by both parties and then makes a decision on the case. Unlike a court judgment, an arbitration award is not subject to appeal. Second, arbitration is generally considered to be a less formal, and faster, method of resolving disputes than a court proceedings. Arbitration proceedings are generally confidential and may be held in a neutral location or at the offices of the arbitrator. Because the proceedings are less formal, the rules of evidence and procedures are generally more relaxed. Finally, arbitration awards may differ from court judgments in that they are usually not legally binding. Though this differs from state to state, in Washington, arbitration awards are generally not subject to enforcement by the court system. This means that if a party does not comply with the arbitration award, the other party cannot force compliance through the court system.
