What are the benefits of using mediation?
Mediation is a form of alternative dispute resolution used in Washington law to settle disputes outside of court. It is a process in which a neutral third party, called a mediator, assists two or more disputing parties in trying to reach a mutually acceptable resolution to their dispute. Using mediation to settle disputes has a number of benefits. One of the primary benefits is that it is usually much faster and less expensive than going through the court system. Since the parties themselves are in charge of deciding the outcome, they can work out their own timetable and budget, which greatly reduces the time and cost associated with the dispute. Mediation is also confidential, meaning that what is discussed in mediation sessions is completely confidential. This assures the parties that their private matters will remain private, which is especially helpful in cases involving sensitive issues. Additionally, since the parties do not need to go to court and possibly face embarrassing or uncomfortable questioning, they can retain more control of their situation. Mediation also works to preserve relationships by keeping the dispute out of court and instead focusing on finding common ground and mutually acceptable solutions. Unlike court, where a judge is responsible for making a decision, in mediation each party has more say in the outcome, which is beneficial for keeping the relationship intact. Finally, mediation is often more effective than court in resolving disputes because the parties are encouraged to find creative solutions and work towards common ground, rather than battling it out in court where a winner and a loser is determined.
