What types of disputes can be addressed through arbitration?

Alternative Dispute Resolution (ADR) is a way of settling disputes without going to court. In California, arbitration is often used as one form of ADR. Arbitration is a process where a neutral third party (the arbitrator) listens to both sides of a dispute, reviews the evidence, and makes a decision. Arbitration can be used to settle a wide variety of civil disputes, including: • Employment disputes related to unfair dismissal, discrimination, or harassment. • Contract disputes, such as those related to a breach of contract or debt collection. • Consumer disputes, such as those involving product defects or service failures. • Intellectual property disputes, such as those involving copyright infringement or trademark violations. • Personal injury or other tort disputes. • Landlord-tenant disputes. • Neighbor disputes. • Divorce and family law matters, such as the division of marital property or child custody. Arbitration may provide a more efficient and cost-effective resolution to many disputes than going to court. The arbitrator’s decision is legally binding, just like a court’s decision. And, the arbitration process usually allows for a relatively quick resolution of the dispute.
